FolderBloom is a service operated by Kushner Management Company LLC ("FolderBloom," "we," "us," or "our"). These Terms govern customer accounts, subscriptions, and use of our file library and gallery service. By accepting these Terms when creating an account or purchasing a subscription, you agree to them. If you use FolderBloom for an organization, you confirm that you have authority to accept these Terms for that organization.
1. What FolderBloom provides
FolderBloom connects selected folders in supported cloud storage accounts to file libraries and photo galleries that you can embed on your website. Supported providers currently include Dropbox and Microsoft OneDrive. Features, supported file types, and plan limits are described on our pricing and documentation pages.
FolderBloom is a publishing service, not a backup service. You remain responsible for keeping your original files and backups. File updates depend on successful synchronization and the availability of your storage provider; changes may not appear immediately.
2. Your account
Account holders must be at least 18 years old. Provide accurate account information, keep your login secure, and notify us at [email protected] if you suspect unauthorized access. You are responsible for activity by users you authorize within your workspace, including employees, contractors, and clients.
Keep a working email address on your account so we can send billing, security, and service notices.
3. Website licenses and plan limits
Each production website domain requires its own annual subscription. The www and non-www versions of the same domain count as one website. A different production domain or subdomain requires a separate subscription. Each licensed site may also have one approved staging origin, and localhost previews are supported.
The base subscription covers file libraries and embeds on that licensed website. Photo galleries require a gallery add-on. Gallery image counts, storage limits, and other applicable limits depend on the selected plan.
We may apply reasonable rate, concurrency, and resource limits to protect the service. We will not charge unapproved overage fees. If you exceed a plan limit, processing or delivery may be restricted until usage is reduced or you select an appropriate plan. We may restrict abusive use even where a feature is described as unlimited.
4. Cloud storage connections and publication
You authorize FolderBloom to access file metadata and content through the permissions you approve with your storage provider. FolderBloom requests read-only access and does not use that connection to modify or delete your original storage files. The provider's authorization screen describes the access granted; authorization may be broader than the folders you choose to publish.
You control which folders are selected for publication and which access settings apply. Selecting a folder can include its subfolders. Review the contents and access settings before publishing. Folder names, file names, captions, and file contents may become available to website visitors according to those settings.
Documents remain in your connected storage and may pass through FolderBloom systems when downloaded. Gallery processing reads source images and stores optimized copies for delivery. Original files remain in your storage. Some gallery plans also allow visitors to download original photos when you enable that option.
Public links can be shared, and public files may be indexed by search engines. Password protection does not prevent an authorized visitor from downloading, copying, photographing, or sharing content. Restricting or removing content cannot recall copies already obtained by visitors or guarantee immediate removal from third-party caches.
5. Your content and permitted use
You keep ownership of your files, photos, captions, and other content. You grant us a limited, nonexclusive permission to access, process, resize, cache, store optimized copies of, and deliver that content as needed to provide the service according to your settings. Our service providers may perform those tasks on our behalf. This permission does not transfer ownership or allow us to sell your content.
You must have the rights and permissions needed to publish your content, including permissions involving identifiable people where required. You are responsible for your website's privacy notices and for lawful handling of personal information in the files you publish.
Do not use FolderBloom to publish unlawful content, infringe intellectual property or privacy rights, distribute malware, bypass access controls, impersonate others, or interfere with the service. Do not publish credentials, payment card details, or private records through public folders. FolderBloom is not offered under a HIPAA business associate agreement and should not be used to publish protected health information requiring such an agreement.
6. Billing and automatic renewal
Subscriptions are billed annually in advance. Your subscription automatically renews each year until canceled. The checkout summary shows the total annual charge, applicable taxes, selected add-ons, and renewal terms. A displayed monthly equivalent is for comparison; it does not mean you are billed monthly.
By expressly agreeing to recurring billing at checkout, you authorize the initial charge and annual renewal charges for the subscription you select. Stripe processes payments. We may use Stripe to collect applicable taxes and billing information.
We will send a renewal reminder approximately 30 days before your annual renewal, identifying the expected charge and how to cancel. We will notify you before a renewal price increase takes effect and give you an opportunity to cancel. A promotion may apply only to the first year if that limitation is disclosed at checkout.
Before you confirm a gallery upgrade or other paid plan change, we will show any immediate charge or credit and its effect on future billing. Any approved proration or credit is handled as disclosed in that confirmation.
7. Cancellation and failed payments
You can stop future renewals through your site's Billing page and billing portal. If you cannot access those tools, email [email protected] for help. Cancellation takes effect at the end of the paid term, and the site's service continues until then unless you request an eligible refund that ends access earlier.
Removing an embed, disconnecting Dropbox or OneDrive, or stopping use of FolderBloom does not by itself cancel a subscription. Cancellation stops future renewal charges; it is separate from a refund request.
If a renewal payment fails, a 14-day grace period normally allows the site to keep serving while payment details are updated. After the grace period, or when a canceled subscription's paid term ends, embeds and links may display an unavailable message. Repeated payment attempts may occur through Stripe's payment recovery process.
8. Refunds
Our Refund Policy forms part of these Terms. It provides a 14-day first-purchase guarantee for each website domain, a 7-day annual-renewal refund window, and a 14-day window for the first separately purchased gallery add-on for that domain. It also explains billing errors and what happens to access after a refund.
Outside those windows, unused time is generally nonrefundable, except as described in the Refund Policy or required by applicable law. These Terms do not limit mandatory consumer rights.
9. Availability, third-party services, and changes
FolderBloom relies on cloud storage providers, payment processing, hosting, and other infrastructure. Outages, provider API limits, revoked permissions, unsupported files, and changes to third-party services can affect syncing or delivery. We do not guarantee uninterrupted service, a specific sync time, or compatibility with every website platform or file.
We may maintain, update, or change the service. If we permanently discontinue a paid feature or the service before the end of your paid term without providing a reasonably equivalent replacement, we will refund the unused portion of the affected subscription charge.
10. Suspension and account closure
We may restrict content or suspend access when reasonably necessary to address unlawful activity, security risks, abuse, or a material breach of these Terms. Where practical, we will explain the issue and give you an opportunity to resolve it. Urgent security or legal issues may require immediate action.
A workspace owner may request closure of an entire workspace from the Team page, or by contacting [email protected] for other account closures. Workspace deletion must be confirmed from the owner's account email and takes effect after a 14-day holding period, during which any owner or admin of the workspace can cancel it; we may verify requests further before acting on them. We will explain the effect on workspaces, sites, subscriptions, and other workspace members before closing an account. Closing an entire customer workspace requires ending its active subscriptions; removing an individual team member does not cancel the workspace's subscriptions.
Information may be retained after closure where needed for billing, legal obligations, security, or dispute handling, as described in the Privacy Policy. We do not delete original files from your cloud storage. Do not rely on FolderBloom retaining gallery copies or configuration indefinitely after service ends.
11. Service ownership
FolderBloom's software, branding, designs, and documentation belong to us or our licensors. Your subscription permits use of the service under these Terms; it does not transfer ownership of our software or authorize copying or reselling the service itself. Agencies may manage separately licensed client websites using the available workspace tools.
12. Disclaimers and limits of liability
To the extent permitted by law, the service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This does not override express commitments in these Terms or rights that cannot legally be excluded.
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, including lost profits or business opportunities. Our aggregate liability arising from the service is limited to the greater of $100 or the amount you paid FolderBloom in the 12 months before the event giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, gross negligence, or liability that applicable law does not permit us to limit. They do not reduce amounts owed under an eligible refund or billing correction.
13. Changes to these Terms
We will post updated Terms with a revised effective date and notify account holders of material changes by email or through the dashboard before they take effect, except where an urgent legal or security change requires earlier action. Changes will not retroactively remove an already-earned refund right. Where renewed consent is required, we will obtain it.
14. Governing law and contact
Texas law governs these Terms, excluding its conflict-of-law rules, except where mandatory protections under the law applicable to you require otherwise. Subject to those protections, disputes may be brought in the state or federal courts serving Collin County, Texas. These Terms do not require arbitration or waive any right that cannot lawfully be waived.
